These Terms of Use (the "Terms") are a legal agreement between you and Arcustin Yapay Zeka Teknolojileri Anonim Şirketi ("Arcustin", "we", "us" or "our"). They govern your access to and use of the Arcustin iOS mobile game that displays or links to these Terms (the "Game"), including its iOS application, gameplay, anonymous player profile, leaderboard, customer support, in-game offers and related services (collectively, the "Services").
By downloading, installing, accessing or using the Game, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy explains how we process personal data and forms part of the legal framework governing the Services.
1. About Arcustin and the Scope of These Terms
The Game is published by Arcustin Yapay Zeka Teknolojileri Anonim Şirketi, a joint stock company established under the laws of the Republic of Türkiye, with its registered contact address at Ayazağa Mahallesi, Kemerburgaz Caddesi, Vadi İstanbul Park Sitesi, 7A Blok No: 7B, İç Kapı No: 4, 34396 Sarıyer/İstanbul, Türkiye.
These Terms apply only to the Game and its related Services. Separate terms may apply to other Arcustin products, websites or services. Apple may also impose platform, payment and usage terms. If a mandatory platform term or applicable law gives you greater rights, those rights are not limited by these Terms.
2. Eligibility, Minors and Parental Responsibility
You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and supervise your use. Where local law requires a higher minimum age or additional parental authorization, that requirement applies.
The App Store age rating describes the suitability of the app's content; it does not replace the eligibility and parental-consent requirements in these Terms. Parents and guardians are responsible for managing device settings, purchase controls and any use of the Services by a minor under their supervision.
3. Anonymous Player Profile and iCloud
The Game does not require a user-facing sign-up or sign-in process, password, email address or real name. The Services create anonymous technical identifiers through Firebase and Supabase so that gameplay, profile, purchases, balances and leaderboard functions can operate. These identifiers are not the same as your Apple Account.
If iCloud is enabled for the Game, selected app settings, state or progress information may sync through Apple's iCloud Key-Value Store. Arcustin does not receive your Apple Account name or email address through this feature. Your use of iCloud is also governed by Apple's terms and settings.
Because the profile is anonymous, access to locally stored or anonymous profile data may be lost if you uninstall the app, erase or replace your device, clear app data, disable iCloud, sign out of iCloud or otherwise lose the local identifier. We do not guarantee restoration of gameplay progress or consumable Virtual Items. Eligible non-consumable purchases may be restorable through Apple's purchase restoration mechanisms.
4. Limited License
Subject to your compliance with these Terms and the applicable App Store rules, Arcustin grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use the Game on Apple-branded devices that you own or control, solely for personal and non-commercial entertainment.
No ownership right in the Services, software, content, player profile, Virtual Items or other game elements is transferred to you. All rights not expressly granted are reserved by Arcustin and its licensors.
5. Acceptable Use and Prohibited Conduct
You must not, directly or through another person:
use the Services in violation of applicable law, these Terms or the rights of another person;
copy, modify, translate, distribute, sell, rent, sublicense or commercially exploit any part of the Services except where applicable law expressly permits it;
reverse engineer, decompile, disassemble, derive source code from, bypass or defeat security or technical restrictions, except to the limited extent that applicable law does not permit this restriction;
use bots, automation, cheats, hacks, mods, unauthorized software, exploits or manipulated devices or network traffic;
exploit a bug or error to obtain an unfair advantage, duplicate Virtual Items, alter scores, manipulate purchases or disrupt the game economy;
interfere with, overload, damage or gain unauthorized access to the Services, systems, data or another player's profile;
scrape, harvest or attempt to identify other players or collect their information;
sell, buy, transfer, trade, gift or otherwise exchange a player profile, score, Virtual Item or entitlement outside mechanisms expressly provided in the Game; or
encourage, assist or attempt any prohibited conduct.
If you discover a security issue, purchase error or exploitable bug, please report it to us and do not use it for advantage.
6. Nicknames, Avatars and Leaderboards
The Game lets you choose a nickname and one of the pre-designed in-game avatars. Your nickname, selected avatar, score and ranking may be visible to other players on the leaderboard. You are not required to use your real name, and you should not include a real name, email address, phone number, location, social-media handle or other personal information in a nickname.
A nickname must not be unlawful, misleading or reasonably considered:
obscene, sexually explicit, hateful, discriminatory, threatening, harassing or abusive;
defamatory or invasive of another person's privacy;
an impersonation of another player, Arcustin employee, public authority or third party;
an infringement of copyright, trademark or another person's rights; or
advertising, spam, a solicitation or an attempt to redirect players outside the Services.
The Game uses a profanity and content filter and provides a reporting mechanism. We may review reports and may reject, reset, edit, hide or remove a nickname or leaderboard entry, and may restrict access where reasonably necessary to enforce these Terms, protect players or comply with law. You grant Arcustin a non-exclusive, worldwide, royalty-free license to host, display, reproduce and moderate your nickname only for operating, securing and promoting the in-game leaderboard and Services. This license ends when the content is deleted, except for limited backup, legal or evidentiary retention.
7. Virtual Items and In-App Purchases
7.1 Current purchase model
The Game may offer one-time in-app purchases such as coins, boosters, season-pass products, bundles, fail offers, continuation rights and ad-free or offline feature packages (collectively, "Virtual Items"). The Game does not currently offer automatically renewing subscriptions. The product name, price, content, duration, limitations and other material terms shown on the purchase screen at the time of purchase form part of your transaction.
7.2 License and value of Virtual Items
Virtual Items are licensed digital content for use only within the Game. They are not money, stored value, securities, property or a payment instrument; have no cash value; cannot be redeemed for cash or real-world goods; and cannot be sold, transferred, traded or exchanged outside the Game. A license to use a Virtual Item is personal, limited, non-transferable and subject to these Terms and the applicable product description.
7.3 Consumable and non-consumable products
Coins, boosters, continuation rights and similar products may be consumable and may be depleted when used. Consumable purchases are generally not restorable through the App Store after they have been delivered or consumed. A product identified as non-consumable may be eligible for restoration using the Game's Restore Purchases function and Apple's systems. The ad-free or offline scope, any exceptions for optional rewarded ads, and the online functions that remain necessary will be the scope displayed before purchase.
7.4 Payment, taxes and refunds
All purchases are processed by Apple through the App Store and are also subject to Apple's payment terms. Arcustin does not receive your full payment-card or bank-account details. Prices and applicable taxes are displayed before you confirm a purchase and may vary by country or storefront. Refund eligibility and refund requests for App Store purchases are handled by Apple, subject to applicable consumer law. You may visit Apple's Report a Problem service to request a refund.
7.5 Delivery errors, reversals and fraud
If a purchase is charged but not delivered, contact us with the non-sensitive transaction information needed to investigate. We may correct duplicate credits, technical errors or balances obtained through fraud, chargeback, refund, exploit or unauthorized activity. Nothing in this section limits a refund, conformity right or other remedy that cannot lawfully be excluded.
8. Advertising and Third-Party Content
The Game currently displays non-personalized rewarded and interstitial advertisements through Google AdMob. A rewarded advertisement is optional and grants the in-game benefit described before viewing when its completion conditions are met. Interstitial advertisements may appear at reasonable transition points. Advertising availability, content and successful delivery can depend on internet access and the advertiser.
An advertisement or external link may take you to a third-party app, site or service that Arcustin does not control. Your interaction with that third party is governed by its own terms and privacy policy. Arcustin is not responsible for a third party's content, products or conduct, except where applicable law provides otherwise.
9. Updates, Game Balance, Availability and Offline Features
We may update the Game to add content, rebalance levels or rewards, change offers, repair errors, improve security or performance, comply with law, or adapt to Apple platform requirements. We may require an update to continue using some features. Material changes affecting purchased digital content will be handled in accordance with applicable consumer law.
The Services may be temporarily unavailable because of maintenance, network interruption, platform failure, security events or circumstances outside our reasonable control. Offline functionality is limited to features designed to work without an internet connection. Purchases, advertisements, cloud sync, leaderboard updates, remote content, support and other online features may require internet access.
10. Suspension, Termination and Discontinuation
You may stop using the Game at any time by uninstalling the app. You may request deletion of personal data as explained in the Privacy Policy. Uninstalling the app does not by itself necessarily delete backend records, and deletion may cause permanent loss of progress, leaderboard status and unused Virtual Items.
We may restrict, suspend or terminate access, remove leaderboard content or adjust improperly obtained Virtual Items when we reasonably determine that you materially or repeatedly violated these Terms, committed fraud, threatened the security or integrity of the Services, harmed another person, or when required by law or a platform provider. Where appropriate and legally required, we will provide notice and a reasonable opportunity to appeal by emailing us.
We may discontinue all or part of the Services for legitimate business, legal, technical or security reasons. We will provide reasonable notice where practical and will respect mandatory rights relating to paid digital content. Sections that by their nature should survive termination, including intellectual property, Virtual Items, liability, disputes and general provisions, will survive.
11. Intellectual Property
The Game and all related software, source and object code, gameplay systems, levels, artwork, in-game characters, animations, audio, music, text, designs, interfaces, logos, trademarks, databases and other materials are owned by or licensed to Arcustin and are protected by intellectual-property and other laws. Except for the limited license expressly granted in these Terms, you may not use Arcustin's intellectual property without prior written permission.
You may capture and share ordinary gameplay screenshots or videos for personal, editorial or non-commercial community purposes, provided that you do not misrepresent an affiliation with Arcustin, disclose confidential or pre-release material, remove notices, or use the material in an unlawful or misleading way. Any commercial use requires prior permission.
12. Feedback
If you voluntarily send ideas, suggestions or feedback, you grant Arcustin a non-exclusive, worldwide, perpetual, irrevocable, royalty-free and transferable right to use that feedback for any lawful purpose without compensation or attribution. This does not transfer ownership of personal data, which remains governed by the Privacy Policy.
13. Privacy
Our Privacy Policy explains the data collected through the Game, how it is used, service providers, advertising choices, retention, international transfers and your rights. Privacy notices and consent choices are separate from your acceptance of these Terms where required by law.
14. Disclaimers
To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. We do not promise that every feature will always be available, that gameplay will be uninterrupted or error-free, or that third-party advertising or platform services will always function. You are responsible for maintaining a compatible device, current software, a secure Apple Account and any internet connection or carrier charges needed to use the Services.
Nothing in these Terms excludes or limits any statutory warranty, conformity guarantee, refund right or other consumer protection that cannot lawfully be excluded or limited.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Arcustin and its directors, employees, affiliates and licensors will not be liable for indirect, incidental, special, punitive or consequential loss, or for loss of profits, business, opportunity or data, arising from the Services when such loss was not reasonably foreseeable or was caused by events outside our reasonable control.
To the fullest extent permitted by law, Arcustin's aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid through the Game during the 12 months before the event giving rise to the claim and (b) USD 100 or its local-currency equivalent. This limitation does not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer right that cannot be excluded or limited by law.
16. Governing Law and Disputes
Before starting formal proceedings, please contact us with a description of the dispute and the requested resolution. You and Arcustin agree to try in good faith to resolve the matter informally for at least 30 days, unless an urgent remedy or mandatory law requires otherwise.
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Subject to mandatory consumer rights and any court or authority that applicable law allows you to use in your place of residence, disputes will be submitted to the competent Istanbul Central (Çağlayan) courts and enforcement offices. Nothing in these Terms deprives a consumer in the EEA, United Kingdom, Türkiye or another jurisdiction of mandatory protections provided by the law of the consumer's residence.
17. Apple App Store Terms
The Game is currently made available through the Apple App Store. Apple's Licensed Application End User License Agreement applies to the license of the app unless a valid custom EULA is provided through App Store Connect. These Terms supplement the Apple terms for gameplay in the Game and related Services.
These Terms are between you and Arcustin, not Apple. Arcustin, not Apple, is responsible for the Game, its content, maintenance and support; Apple has no obligation to provide maintenance or support, subject to Apple's platform responsibilities.
Your license is limited to use on Apple-branded products you own or control and as permitted by the Apple Media Services Usage Rules, including applicable Family Sharing rules.
To the extent a warranty applies and the Game fails to conform, you may notify Apple and Apple may refund the purchase price of the app, if any, as provided by Apple's terms. To the maximum extent permitted by law, Apple has no other warranty obligation for the Game.
Arcustin, not Apple, is responsible for addressing claims relating to the Game, including product-liability, legal-compliance and consumer-protection claims, and for investigating intellectual-property infringement claims.
You must comply with applicable third-party terms and represent that you are not prohibited from receiving the Services under applicable sanctions or export-control laws. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
18. Changes to These Terms
We may update these Terms for legal, regulatory, security, technical or operational reasons or when the Services change. We will post the updated version and revise the "Last updated" date. If a change materially affects your rights, we will provide additional notice or request renewed acceptance where required. Changes do not apply retroactively unless the law requires or permits it. If you do not agree to an updated version, you must stop using the Services.
19. General Provisions and Contact
These Terms, the Privacy Policy, product descriptions and mandatory App Store terms form the agreement for the Game. If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary; the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, reorganization, financing or transfer of the Services, subject to law. These Terms do not create a partnership, agency, employment or joint venture.
